Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of the RX Library service operated by Proven Theory LLC (“RX Library,” “we,” “us”). By creating an account or using the service, you agree to these Terms.

2. Telehealth services

RX Library is a technology platform that connects patients with independent licensed clinicians. RX Library does not itself practice medicine. The clinician evaluating your case operates an independent practice through our provider network partner (MD Integrations). The clinician—not RX Library—makes any clinical decisions.

A consultation is required for every prescription. Treatment may be declined if the clinician determines it is not clinically appropriate. The consultation fee is paid whether or not a prescription is issued.

3. Eligibility

You must be at least 18 years old, a resident of a U.S. state where our clinicians are licensed, and able to provide accurate medical information. You agree to give honest answers in the intake questionnaire. Falsifying medical information may result in account termination and may put your health at risk.

4. Not for emergencies

RX Library is not for medical emergencies. If you are experiencing an emergency, call 911 or go to the nearest emergency room. Do not use this service to communicate information requiring immediate attention.

5. Fees and billing

You agree to pay all fees displayed at checkout. Charges may include the medication cost and a Telehealth Consultation Fee paid to the independent licensed clinician for their professional review. The consultation fee is non-refundable once a clinician has reviewed your case, regardless of whether a prescription is issued.

Payments are processed through Stripe. Subscriptions auto-renew until cancelled.

6. Prescriptions and pharmacy

If a clinician prescribes treatment, the prescription is transmitted electronically to a partner pharmacy. The pharmacy may contact you to verify the order or confirm delivery. Medication shipping is not guaranteed within a specific timeframe; weather, carrier delays, or pharmacy inventory may affect delivery.

7. Refunds

Consultation fee: Non-refundable once review begins.
Medication: Federal regulations prohibit returning dispensed medications. We may issue a refund only if (a) the clinician declines treatment before dispensing, or (b) the medication was not shipped due to our error.

8. Account responsibilities

You are responsible for keeping your password secure and for all activity on your account. Notify us immediately at support@pharmacytime.com if you suspect unauthorized access.

9. Acceptable use

You may not: (a) use the service for anyone other than yourself, (b) reverse-engineer or scrape the platform, (c) misrepresent identity or medical information, (d) interfere with the security or operation of the service.

10. Limitation of liability

To the fullest extent permitted by law, RX Library is not liable for any indirect, incidental, consequential, special, or punitive damages. Our aggregate liability is limited to the amount you paid us in the twelve months preceding the claim.

RX Library is not liable for the medical advice or decisions of the independent clinicians who consult through the platform. Those clinicians are responsible for their own clinical judgment and carry their own malpractice insurance.

11. Dispute resolution

Disputes will be resolved through binding arbitration administered by the American Arbitration Association in Miami-Dade County, Florida, except for small claims court matters. You waive any right to a jury trial or class action.

12. Termination

We may suspend or terminate your account if you violate these Terms or if continued service poses a safety or compliance risk. You may close your account anytime by contacting us.

13. Changes

We may update these Terms. Material changes will be notified by email and/or in-app notice. Continued use constitutes acceptance.
